Agreeing to these terms
These terms apply whenever you use the Avelby website or buy from us. By placing an order or creating an account, you agree to them. Wherever it says "we" or "us", it means Avelby, and "you" means you, our customer.
Our Shipping & Delivery, Returns & Exchanges and Privacy Policy pages are part of these terms. If you do not agree with them, please do not use our store.
Who can shop with us
To order or create an account, you must be at least 18, or the age of majority where you live, or shop with a parent or guardian who agrees to these terms. We deliver only to addresses in the United States. Our lamps are welcome anywhere, from homes to restaurants, offices and hotels, but they are not sold for resale.
Your account
An account is optional. If you create one, please keep your details accurate and your password private, and tell us right away if you think someone else has used it. You are responsible for what happens under your account. We may suspend an account that is used for fraud or against these terms, and you can ask us to delete yours at any time.
Our lamps
We describe and photograph every lamp as accurately as we can, but some differences are natural:
- Colors and finishes can look slightly different on your screen than in your room.
- Glass, ceramic, stone, paper and wood vary a little from piece to piece, so small marks, bubbles or grain are part of their character, not a fault.
- Measurements are approximate and may differ slightly from the ones listed.
- Bulbs and styling in the photos are included only when the product page says so. Rooms, tables and decor aren't included.
A lamp can sell out or change while you shop. If something you ordered becomes unavailable, we will tell you and refund it in full.
Electrical safety and installation
Our lamps are made for standard U.S. power of 110–120 volts. For your safety:
- have a licensed electrician install ceiling and wall lights that connect to the building's wiring, following your local codes
- follow the instructions that come with your lamp
- use only the bulb type and the maximum wattage shown on the product page or the lamp
- use a lamp outdoors or in a bathroom only if its product page says it's suitable
- don't change or repair a lamp's wiring yourself
If a lamp is faulty, stop using it and write to us. To the extent the law allows, we are not responsible for damage caused by installation by someone unqualified, by changes to a lamp, or by using it in a way its instructions warn against.
Prices and payment
Prices are in U.S. dollars. Delivery is free, and any import duties and taxes are already paid by us, so the total you see at checkout is all you pay, with nothing to pay on delivery.
You can pay by card or with a digital wallet through Stripe, our payment processor, and your payment is taken when you place your order.
- Pricing mistakes. If a price on our website is clearly wrong, we may cancel the order before it ships, tell you why and refund you in full.
- Discount codes. One code per order unless it says otherwise. A code has no cash value, can't be used on an earlier order, and may expire or have conditions, which we show with the offer. The welcome discount for new subscribers applies to a first order.
- 30-day price match. If a lamp you bought goes down in price on our website within 30 days of your order, write to us and we refund the difference to your original payment method. It must be the same lamp, in the same finish, size and quantity, bought on our website and in stock when you ask. We match our own prices only, not other stores', and not clearance items, flash sales, bundle deals or prices lowered by a code.
Your order
The email we send after you order confirms that we have received it. We may decline or cancel an order, for example when a lamp is no longer available, a price is wrong or a payment looks fraudulent, and if we do, we refund you in full.
You can cancel any lamp that has not shipped yet, from your account or by writing to us with your order number. Once a lamp is on its way, you can return it instead.
Shipping and delivery
We deliver to all 50 U.S. states, free and with tracking. Every product page shows an estimated delivery window before you order. Lamps in one order may arrive in separate parcels.
- If your order is late. If we can't ship within the time we told you, or within 30 days when we gave no time, we will let you know, give you a new estimate and let you cancel for a full refund. If we can't ship it at all, we will refund you promptly.
- A thank-you for waiting. If your order arrives after the last day of the delivery window we showed when you ordered, write to us and we send you a 10% off code for your next order. This doesn't apply when a delivery is held up by a wrong address or a missed delivery attempt.
- If it goes missing. If a parcel is lost on its way to you, we send a new one, free of charge.
- Once it arrives. A lamp is yours, and its care is too, from the moment it is delivered. If it arrives damaged, we replace it, as Returns explains below.
Returns, refunds and damaged lamps
You can return or exchange a lamp within 30 days of delivery, in its original packaging. Return shipping is free: we email you a prepaid label. Your refund goes back to your original payment method within 5 days of the return reaching us. If a lamp arrives damaged or faulty, send us a photo of it and its box within 30 days of delivery, and we'll send you a new one, free of charge. A fault that appears later is covered by our Limited Warranty below.
Our Returns & Exchanges page explains how a return works, step by step.
2-Year Limited Warranty
Every lamp you buy from Avelby comes with our 2-year limited warranty. It covers you, the original buyer, and anyone you give the lamp to as a gift, for 2 years from the day the lamp is delivered.
- What it covers. Defects in materials and workmanship that appear under normal use, in a home or a business, including built-in LEDs, drivers, switches and wiring.
- What it doesn't cover. Replaceable bulbs; a rechargeable battery's normal loss of capacity over time; normal wear, and the natural patina, fading or variation of materials such as brass, wood, stone and glass; damage from accidents, misuse or power surges, or from use outdoors or in a bathroom when the product page doesn't say the lamp is suitable; and installation, repairs or changes not done as the instructions say.
- What we do. We send you a new lamp of the same model. If it's no longer available, we send you a comparable one or refund what you paid for it, whichever you prefer. We pay all the shipping, and a replacement is covered for the rest of the original warranty.
- How to claim. Email us at support@avelby.com with your order number, a short description of the problem and a photo or video of it. We reply within 2 business days. We may ask you to send the lamp back, at our cost, so we can look at it.
This warranty doesn't limit how long any implied warranty lasts, such as the warranty that a product is fit for its ordinary use. We are not responsible for incidental or consequential damages, such as the cost of an electrician. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
Reviews and what you send us
When you review a lamp, please share your own honest experience. We welcome every honest review, including critical ones: we never remove or hide a review because it's negative, and these terms never stop you from sharing your opinion of us anywhere.
- we may remove reviews that are fake, unrelated to the lamp, offensive, unlawful or that share private information
- we never write reviews ourselves or pay for them, and if we ever give anything in return for a review, we'll ask for an honest one and say so with it
- by sending us a review, photo or idea, you let us show it on our website and in our communications, with your first name
Using our website
The photos, texts, designs and logo on our website belong to Avelby or to those who let us use them, and you may not copy them without our permission. Please use our website only for lawful shopping: do not try to break into it, copy it automatically, disrupt it, or use it to deceive anyone.
Emails and text messages
We email you about your orders, such as their confirmation, delivery and returns. We send news and offers only if you sign up for them, and every marketing email has a link to unsubscribe.
If you agree at checkout to receive texts from Avelby:
- you will receive recurring automated marketing messages about new arrivals and offers, at the number you gave us
- consent is not a condition of purchase
- message frequency varies, and message and data rates may apply
- reply STOP at any time to unsubscribe, or HELP for help, or write to us at support@avelby.com
- mobile carriers are not responsible for delayed or undelivered messages
Our Privacy Policy explains how we handle your number and email, and we never share your text consent with anyone for their marketing.
Other services
Payments are handled by Stripe, Google sign-in by Google, and deliveries by our carriers, each under its own terms. If our website links to another website, we are not responsible for its content.
Limits of our responsibility
To the extent the law allows, we are not responsible for losses that are indirect or that could not have been expected when you ordered, such as lost profits or lost time, and our total responsibility for an order is limited to what you paid for it.
Nothing in these terms limits our responsibility for injury caused by our negligence, for fraud, or for anything else the law doesn't let us limit, and nothing takes away your rights as a consumer under your state's law.
Some states don't allow these limits, so they may not apply to you. If you live in New Jersey, they don't apply to the extent New Jersey law doesn't allow them, including to injury or damage caused by our negligence.
Disputes and governing law
If something goes wrong, please write to us first: almost every problem is solved quickly that way. If we can't solve it together, you may bring your claim in small claims court or in another court where you live. These terms are governed by U.S. federal law and the law of the state where you live.
If you live in California: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs can be reached in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (916) 445-1254 or (800) 952-5210.
Changes to these terms
We may update these terms from time to time, and the date at the top of this page shows when they last changed. An order is always covered by the terms in place when you placed it.
The rest of the fine print
These terms, with the pages they mention, are the whole agreement between you and us. If a court finds part of them invalid, the rest still applies. If we do not enforce a part right away, we can still enforce it later. We are not responsible for delays caused by events outside our control, such as severe weather, carrier disruptions or natural disasters, though your right to cancel a late order always remains.
